The Phoenix City Council approved Ordinance S-51875 granting a perpetual public utility easement on city-owned property at 5902 W. Indian School Road for the installation and maintenance of electrical facilities to serve the new Maryvale Golf Course building. This easement includes rights of ingress and egress for public service corporations for construction of a pad-mounted transformer and utility lines. Under the terms, the Grantee may construct, reconstruct, replace, repair, operate and maintain utility facilities and share the easement premises with other providers. The city reserves the right to locate improvements outside the easement area and coordinate facility placement within the easement. Changes to the grade of the easement premises greater than two feet require Grantee approval. Grantee may not store hazardous materials or use the easement for construction storage except temporarily. A three-foot clearance around equipment pads and a 10-foot operational area in front of transformer openings must be maintained. Grantee must restore any disturbed areas to original condition. The city may require relocation of facilities at its expense and provide a comparable easement. Transfers of the easement interest require city consent. Non-emergency access must be coordinated with city departments one business day in advance. The easement is recorded in perpetuity for the SRP service area under Maricopa County assessor parcel number 144-43-001F.
