On April 6, 2023, the Phoenix Abandonment Hearing Officer granted conditional approval for abandonment application ABND-220065 to vacate the public alley north of East Mulberry Drive and east of North 47th Street. The request, submitted by residents of El Coronado Estates AMD and represented by attorney Karen Palecek, seeks to remove city ownership of the alley and allow homeowners to extend their backyards and fences into the former right-of-way. City staff and the hearing officer stipulated that all existing utility and maintenance access must be retained via public or private easements, requiring either relocation of utilities or retention of a 24-hour vehicle maintenance access easement. A fair market value or prescribed fee must be paid as consideration for the vacated right-of-way under Phoenix City Code Article 5, Section 31-64. The eastern segment of the alleyway will remain open to provide access and turnaround through the SRP Cross-Cut Canal right-of-way, as approved by Water Services and Street Transportation departments. Homeowners must execute and present any required private easements from utilities prior to City Council adoption. The applicant must complete all stipulations, including posting performance agreements for any utility relocations or easements, within two years or seek a one-year extension with fees. Staff report modifications amended stipulations regarding retention of easements and termination points based on access requirements.
