The Louisville Metro Planning Commission reviewed and recommended amendments to Section 4.3.14 of the Land Development Code (LDC) concerning density and occupancy requirements for transitional housing in R-5A and R-5B zoning districts. The proposed changes aim to adjust the by-right occupancy for these districts to a maximum of three residents per dwelling unit or lot, aligning them with single-family zoning standards. This amendment clarifies that the three-occupant allowance applies per existing dwelling unit and continues to allow for conditional use permits (CUP) if special standards are not met. The changes also reorganize the section for improved readability. The proposal was prompted by a Metro Council Resolution (R-130-24) passed on November 21, 2024, which requested a review of transitional housing density standards and imposed a temporary moratorium. Staff analysis indicated that current LDC provisions for R-5A and R-5B result in significantly higher potential densities for transitional housing compared to single-family districts, particularly when facilities are not constructed as dwelling units but rather operate under commercial codes. The Commission's recommendation aims to address concerns about the impact of group housing on residential neighborhoods and prevent overconcentration in certain areas.
