On April 7, 2025, the Louisville Metro Board of Zoning Adjustment approved case 25-VARIANCE-0012 to allow the existing structure at 1016-1018 Payne St to encroach into the required side yard setbacks. The variance grants relief from the 3-foot side yard requirement—per LDC table 5.2.2—by permitting 1.5 feet on Lot 1 and 1.85 feet on Lot 2, thereby preserving interior renovations without altering the footprint. The subject property, zoned R-6 Multi-Family Residential in the Traditional Neighborhood form district, was recently approved for subdivision under case #24-MPLAT-0156 but not yet recorded. Staff found that strict application of the setback standards would create an unnecessary hardship by preventing maintenance of the two dwelling units. No new exterior work is proposed, and all interior renovations will comply with building and safety codes. The Board determined there would be no adverse impact on public health, safety, or neighborhood character, as the existing buildings already align with adjacent homes. Notification materials were sent to first-tier adjoining property owners, neighborhood groups, and a sign was posted on the property.
