This ordinance amends Louisville Metro Code of Ordinances Chapter 90 to add an exemption for cigar bars to the city’s prohibition on indoor smoking in public establishments. It defines a “cigar bar” as an on-premises retail drink license holder that derives at least 15 percent of annual gross income from sales or rental of cigars, pipe tobacco and related accessories, prohibits sales and entry by persons under 21, and restricts indoor smoking to cigars and pipe tobacco only. Eligible cigar bars must obtain an annual Chapter 90 license, comply with all local, state and federal tobacco distribution laws, prevent smoke from migrating into adjacent enclosed spaces, provide a smoke-free area for deliveries, and post notices at each entrance warning that only cigar and pipe tobacco smoking is permitted. Electronic cigarettes, vaporizers and non-tobacco smoking remain prohibited inside. The measure preserves private property rights to ban smoking entirely and does not override any fire code or other legal smoking prohibitions. The ordinance takes effect upon passage.
