This ordinance rezones the 0.1036-acre property at 2213 South Preston Street from C-1 Commercial to C-2 Commercial to allow the existing building to be renovated into a tattoo parlor while retaining a residential unit in the rear. Lucky Neko Tattoo LLC, represented by owner Kandace Dyer, will convert the street-facing storefront into a licensed personal service establishment for tattooing. Access will continue via the adjacent rear alley, and an existing cell tower on site limits the buildable envelope. A Detailed District Development Plan with five binding elements was approved, including construction fencing for off-site tree protection, required agency approvals, and submittal of encroachment permits for work in the Preston Street right-of-way. No new building footprint expansion is contemplated; all existing drainage, pedestrian, and traffic infrastructure will remain in place. The binding elements run with the land and require implementation before a certificate of occupancy may be issued. Traffic and parking impacts are expected to be minimal given the small scale and limited hours of operation. Metro Planning Commission and Metro Council review determined consistency with Plan 2040’s Traditional Marketplace Corridor form district policies.
