This resolution amends a concession agreement between DOC. 1 Solutions, LLC d/b/a Superfruit Republic and Denver International Airport (DEN). The amendment extends the agreement by five years, changing the end date to January 1, 2035. This extension is granted due to increased costs incurred by the concessionaire to design and build a concession at DEN, allowing them to amortize their investment. The total agreement amount, a Minimal Annual Guarantee (MAG) of $410,126.00 or 16% of Gross Revenue, remains unchanged. The original contract term was 7 years, now extended to 12 years. DEN is not providing additional funding or capital investment for this project, as the space was turned over as-is. This initiative aligns with DEN's Vision 100 goal to enhance infrastructure by adding new concession opportunities to meet future passenger demands and increase non-aeronautical revenue. The amendment also includes updates to various contractual provisions to ensure compliance with current standards.
