This resolution amends a concession agreement between Emerging Airport Partners, LLC, d/b/a Half Moon Empanadas and Denver International Airport (DEN). The amendment extends the agreement by five years, changing the end date to January 1, 2035. This extension is necessitated by increased costs incurred by the concessionaire to design and build the concession at DEN. The agreement amount, a minimal annual guarantee of $379,148.20 or 16.5% of gross revenue, remains unchanged. This contract adjustment helps Half Moon Empanadas amortize their investment due to unforeseen capital cost increases. DEN will not provide additional funding or capital investment. The project aligns with DEN's Vision 100 goal of "Growing Our Infrastructure" by introducing new concession opportunities to enhance customer experience and increase non-aeronautical revenue. The amendment also includes updates to various contract provisions such as Key Dates, Business License Address identifier, and Midterm Refurbishment Requirements, to ensure compliance with current standards.
